Woman Who Taped Dog To Fridge Gets Jail Time

A former University of Colorado student convicted of taping her boyfriend's dog to a refrigerator was sentenced Friday to 30 days in jail.

Abby Toll, 21, could have faced 18 months in prison for felony animal cruelty after she was found guilty last April. She will also be required to attend classes for domestic violence, mental health and anger management.

The judge also sentenced Toll to 200 hours of community service, levied a $500 fine and put her on three years probation.

Police who were called to a disturbance in a Boulder apartment in April 2009 found a 2-year-old Shiba Inu taped upside down to the refrigerator. Police said Toll told them she taped the dog, named Rex, because it had defecated on the carpet.

The original arrest report stated that when Toll's boyfriend saw the dog taped to the fridge he said, "Take him down, you are so sick."

Toll became angry and said, "No, you are sick for not caring enough about me to get rid of the dog.”

Toll's boyfriend, Brian Beck, was cited for misdemeanor attempted animal cruelty in the case for not immediately rendering assistance to Rex. He had also pleaded guilty and was given a deferred sentence and 50 hours of community service.

Rex was put up for adoption after the incident and a new family renamed him Yoshi, which they say is Japanese for good luck.
